Terms and Conditions

“By submitting your registration form you agree to our Terms and Conditions”

1. These terms and conditions are valid for all workshops, conferences, seminars or any other form of live event provided by the Megatrends Academy. They constitute an agreement between the Megatrends Academy represented by Dr. Ulrich Winkler and the person or institution requesting that they personally or their employees attend a Megatrends Academy workshop, conference, seminar or any other form of live event provided by the Megatrends Academy.
2. The contract terms for attending a workshop, conference, seminar or any other form of live event provided by the Megatrends Academy shall be based solely on these terms and conditions. We reserve the right to modify the terms and conditions at any time at our sole discretion. Any change of this sort has to be made public via the website.
3. A request to attend a Megatrends Academy live event must be made by submitting the fully completed registration form on the Megatrends Academy website. A participant or his/her representative who submits the event registration form is responsible for full payment of the relevant fees at the time of registration and is deemed to have accepted these Terms and Conditions by making the payment.
4. You will receive a confirmation of registration in text form. The confirmation of registration email you receive directly after submitting the registration form merely serves as information that we have received the form and does not represent an acceptance of your offer. The Megatrends Academy will either accept or reject the event registration form (at its sole discretion and without providing reason) and will notify the participant of its decision in writing. The request to attend is only deemed accepted after the participant receives written confirmation of the registration by the Megatrends Academy. In the unlikely case of rejection of the request to attend, the fees or deposit paid by the participant will be refunded in full within 5 working days after sending the rejection.
5. The number of potential participants for any live event of the Megatrends Academy is limited. Registrations are considered on a first come first serve basis.
6. Cancellation is possible up to 31 days before the start of the event. Cancellations have to be in writing. A refund will be paid to the participant within 10 working days after receiving the cancellation. For cancellations received 30-14 days before the start of the event, 50% of the paid tuition will be refunded. For cancellations received 13 days or less before that start of the event, no refund will be paid.
7. In case of a no-show or if participation is only possible partially for a participant, the full fee must nevertheless be paid.
8. A participant may provide a replacement at any time before the start of the event. If a participant is to be changed this must be done by written notification to the Megatrends Academy before the start of the event.
9. Megatrends Academy will make all reasonable effort to ensure that the faculty teaching, facilitating or leading the event will be the same as advertised. Under exceptional circumstances faculty may be changed by the Megatrends Academy without providing notice to the participant.
10. The venue and time of the event may, under exceptional circumstances, be changed or the event be cancelled. In particular this can be the case if the required minimum number of participants is not achieved or in the case of force majeure (confirmed illness of faculty / breakdown of heating / strikes / natural disasters, etc.). The Megatrends Academy will make all reasonable effort to inform the participant of the change. In case a participant is not able to attend the event at the changed location/time or in case of a cancellation, a full refund of the paid fees will be provided to the participant. The Megatrends Academy is not liable for any travel, accommodation or any other expenses the participant might have incurred.
11. Every reasonable effort has been undertaken by the Megatrends Academy to ensure correctness, completeness, accuracy and timeliness of the content and information provided during Megatrends Academy events. Nevertheless, the Megatrends Academy does not accept liability for any error, incompleteness, or otherwise inadequacy of the content provided during its events. We do not accept any liability for any loss or damage which a participant might incur by relying on it. In no event shall we be liable to you or any third party for any direct, indirect, incidental, special or consequential damages whatsoever. Including without limitation lost revenue, lost or damaged data, or other commercial or economic loss.
12. All intellectual property rights regarding the translation, distribution via social networks, reprint, or any other form of duplication or publication of the materials provided during the event are reserved. The materials may not be used in their entirety or parts of them for commercial uses without the written consent of the Megatrends Academy.
13. The liability of the Megatrends Academy shall be limited to the type of risk typical for this type of contract at the time of its conclusion. All further liability is excluded. In particular we shall not be liable for any of the actions of third parties that teach for us or support the delivery of an event in any other form.
14. The participant agrees that his/her data is collected, processed and stored by the Megatrends Academy. Parts of this data or its entirety can be forwarded to third parties if the delivery of the event requires so (e.g. in the case of external faculty). The participant has the ‘right to be forgotten’ after the event.
15. Each event is priced individually. The relevant price at the time of purchase is published on the program page on our website. Fees are subject to change.
16. If a participant interferes substantially with the orderly progression of the event, he/she can be excluded from the further participation of the event, provided at least three warnings have been issued. In the case of an exclusion, the participant has no right to be reimbursed.
17. An event might be recorded as video or audio in parts or in its entirety. Parts of these recordings might be used as promotional material. The privacy of the participants and all of the information they provide (e.g. through questions or examples) shall at all times be respected and neither their faces nor their information be made public in any way unless they have given their consent to do so.
18. None of the examples or cases provided, external experts involved or quoted, or names and lists provided during events represent a recommendation of these individuals or organizations of any sort.
19. The Megatrends Academy has the right to mention the participants’ company in its list of customers.
20. If any term, clause, or provision of this contract is held invalid or unenforceable, this invalidity shall not affect the validity or operation of any other term, clause, or provision of this contract.
21. These Terms and Conditions are governed by the laws of Spain. The sole venue of any dispute in relation to them will be heard by the courts of Palma de Mallorca, Spain.
